Welcome to the website of the INTERNATIONAL TRAIL RUNNING ASSOCIATION (“ITRA” or “we” or “us”).  This website provides visitors, users, and members with tools for accessing and managing the results of trail races worldwide and related statistics. 

By accessing this website, you accept the terms and conditions below, and you acknowledge having read and understood them in their entirety, including warranty exclusions and limitations of liability.  Please appreciate that the terms and conditions apply, without restriction or reservation, to all information and services offered by ITRA on this website, except where we have expressly stated otherwise.

Please visit this website often, as we may change these terms and conditions (as well as the services we offer through this website) from time to time.  The terms and conditions take effect from the time of their publication on this site to the time they are changed.

Preamble

The aim of ITRA is to contribute to the development of trail running by giving a voice to all those involved in the sport, by promoting the underlying values and diversity of trail running, and by contributing to improvements in the quality and safety of races and in runners' health.  ITRA publishes this website with the following objectives:

  • to introduce Visitors to the actions and objectives of the ITRA;
  • to promote trail running and its values around the world, in particular with the support of national ambassadors;
  • to maintain constructive relations and collaborate with national trial associations, national and international athletics federations;
  • to provide a range of services for the organizers of trail races — in particular, by promoting their events in the ITRA calendar, publishing their results, evaluating the course of races, and providing a qualification system for the registration of runners in races; and;
  • to provide a range of services for trail runners, in particular the calculation of a score (rating), which represents the performance on any given race, and of a Performance Index, thereby allowing runners to compare their performances with those of other runners worldwide.


Article 1. Definitions

The definitions below have the same meaning whether used in the singular or the plural.

"Bank Card" means a debit or credit card that is accepted by the Payment System and that is used in payment of a Membership subscription.

DPO” means the Data Protection Officer responsible for processing personal data on the ITRA website.

"Force majeure" means all fire and flood, and all-natural elements or other natural disasters, all declarations or escalations of hostilities, wars, riots or public disturbances, acts or omissions of the government or hold-competent authorities, breakdowns, freezes, technical faults, or modifications in telecommunications installations or networks, or any other causes, similar or not similar to the above-mentioned causes, being beyond the reasonable control of a party to a contract and resulting in any failure or delay in the performance of its obligations under the terms of that contract.

"General Conditions" means the terms and conditions applicable to Visitors, Users, and Members, including but not limited to those presented in this document and those presented in the ITRA Privacy Policy.

Him” and “his” are used in a gender-neutral sense throughout this document.

"Intellectual Property" means all intellectual property rights, including but not limited to rights under the patent, copyright, and trademark laws of every applicable jurisdiction, and further including by way of non-limiting example the neighboring rights of performers and phonographic and video graphics producers, moral rights, rights to all models, rights to all databases, and know-how, registered or not, or which can be registered or not, anywhere in the world.

"ITRA" or the "Association" means the International Trail Running Association, an Association under Swiss law (Company Registration No.: pending) registered at World Trade Center Av. De Gratta-Paille 2, 1018 Lausanne, Switzerland.

ITRA account” or “account” means an account set up on this website and allowing access to certain services and information, e.g., relating to race results.  A free membership account is an account.  A subscription account is a member account.

"Member" means any Runner or Organizer who has set up an account on the itra.run website and whose membership subscription is fully paid-up.  Members benefit from specific services to which non-member users of this website do not have access. 

"Membership subscription" means any sum of money collected by ITRA from members for access to this website and use of ITRA services.

“Organizer” or “organizer” means any person or entity that has organized a race or trail running race.

"Party" and “Parties” means, according to the circumstances, ITRA and/or any Visitor, User or Member to whom the General Conditions apply,

"Payment system" means a payment system used on this site to accept payment from Visitors, Users, and/or Members.  

Privacy Policy” means the ITRA Privacy Policy at http://itra.run/Info/PrivacyPolicy.

Ranking” means race results provided by an Organizer via his ITRA account and including the following information for each runner:  full name, date of birth, nationality, gender.

"Refund(s)" means refund to a Member by ITRA of all or part of the Member's subscription.

“Runner” or “runner” or “trail runner” means any person participating in a competitive trail running event as defined by the IAAF (see the IAAF Competition Rules, Article 251) and on the ITRA website (https://itra.run/About/DiscoverTrailRunning).

"Service(s)" means one or more services, paid or free, offered by ITRA to visitors, Users, and/or Members on this website.

This "site" or "website" or “ITRA website” refers to http://itra.run.

"User" means a Visitor who has registered on the site by setting up an account. This includes Members.

"Visitor" means any person who visits this website. This includes Users and Members.

Article 2. Content

2.1. Accessibility to the Site

ITRA will endeavor to make this site accessible twenty-four (24) hours per day, seven (7) days per week unless otherwise specified. However, we cannot be held responsible in the event the site provides slow, interrupted, and/or spotty response or in the event the site is unavailable, whether as a result of force majeure, maintenance, updates, network failure, or incorrect configuration or use of the Visitor's, User's or Member's computer or otherwise, regardless of who is at fault. In addition, we cannot be held responsible if the site is incompatible with Visitor devices and software. 

Any information found on or transmitted through this website or sent or forwarded by a Visitor to this website is generally sent as unencrypted data over an open network (e.g., the Internet). It is Visitor’s responsibility to transmit information to ITRA in a protected, encrypted form, if necessary. If the information contained on this website or the host systems supporting it are abused, criminal proceedings may be initiated against those responsible.

2.2. Nature of the information on the Website

The content of this website is subject to change without notice, and the Visitor explicitly acknowledges that the use of the website is at his own risk and his sole responsibility. The Visitor recognizes and accepts that information provided on the website (i) may include inaccuracies, errors, and/or omissions, (ii) may be out of date, and (iii) is as it stands, is for guidance only and should not be relied upon, ITRA disclaims all responsibility for decisions taken on the basis of information provided by this website.

2.3. Bugs and viruses

ITRA assumes no liability for the sound functionality and operational stability of the HTML markup language, JAVA Scripts, and/or other data codes downloaded from this website. In particular, we point out that such data codes could harbor risks caused by viruses, bugs, and so forth. We cannot offer assistance or be held responsible for any direct or indirect damage or for any loss or costs to Visitor equipment, software, or otherwise resulting from such data codes or other use of the website.

2.4. Hyperlinks
When hyperlinks on the website direct Visitors to other internet websites, ITRA disclaims responsibility for the content of those sites. If third-party websites contain hyperlinks to this ITRA website, ITRA assumes no liability for the content of the hyperlink or for any third-party statements made in connection with such hyperlink.

2.5. Advertising

This website may contain advertisements for third-party goods and/or services. ITRA can in no way be held responsible for either the content of those advertisements or the consequences of a possible contractual relationship between the Visitor and the party responsible for the advertisement.

2.6. Newsletter

A Visitor can subscribe to the ITRA Newsletter by entering a valid email address. An “unsubscribe” link is included in each newsletter sent to the Visitor.

Article 3. Paying for Membership Subscriptions

3.1. Payment

Payment for Membership subscriptions may be made using means supported by the Payment system. By making payment for a Membership subscription, the Visitor, User, or Member, as the case may be, (i) accepts the terms and conditions of the Payment system and (ii) declares that the source of the funds used by him for such payment is not illegal and that such payment is not being made for any illegal or fraudulent activity, in particular for the laundering of money. ITRA commits to use monies paid for Membership subscriptions for achieving the mandate of the Association.

3.2. Age and Professional Affiliation

In order to become a Member, it is necessary to (i) be at least eighteen (18) years of age and to be legally capable of entering into a contract, and (ii) declare that the prospective Member will use the site and Services for non-professional purposes only. ITRA reserves the right to cancel memberships upon violation of these terms and for other reasons within its sole discretion.

Article 4. Intellectual property

This website and the Intellectual Property accessible herein are the exclusive property of ITRA and/or its partners. This includes information, documents, presentations, videos, brochures, drawings, flyers, photographs, illustrations, graphics, texts, designs, charts, logos, brand names, all by way of non-limiting examples. Visitors, Users, Members, and all others are prohibited from reproducing, copying, modifying, adapting, translating, selling, publishing, disseminating, and using (other than for personal purposes) this website or such Intellectual Property in any form whatsoever without ITRA’s express written permission.

Article 5. Additional Legal Terms

5.1. Force Majeure.

The Parties will not be held liable or considered to have failed with regard to the present Articles in the event of delay or non-performance when the cause thereof is linked to a case of force majeure.

5.2. Severability

If any of the stipulations herein is considered null or void, it will be deemed unwritten and will not result in the nullity of the other stipulations. Likewise, if one or more of the stipulations herein lapses or is declared lapsed pursuant to a law, a regulation, or consequent upon a final decision rendered by a competent court, the other stipulations will remain binding, and the scope thereof will be unchanged. The stipulations declared null, and void will be replaced by the stipulations the meaning and scope of which is closest to the stipulations initially agreed.

5.3. Applicable Law

The parties agree that the terms and conditions hereof are governed, interpreted, and applied under Swiss law and that only the Swiss courts in whose jurisdiction the head office of the ITRA is established shall be competent to hear any disputes hereunder.
